Subsequent impossibility - Legal consequences

  • Fault of the debtor (seller)

  • Creditor has the choice between:

    • Withdrawal from the contract

    • Claim for compensation

  • Accidental impossibility

    • Withdrawal from the contract
  • Fault of the creditor (e.g. buyer)

    • Contract remains in force

    • Creditor receives the destroyed item (if possible at all)
